An ‘old school’ boss has been sentenced to paying his former assistant compensation over sexist remarks he made.
Leslie Easton, 78, told Tina Donlon to take her clothes off, suggested she should have oral sex and sent her more than 100 abusive messages.
After an incident in June 2017, she took the owner of the window glass company to court when a customer said she was lucky enough to wear shorts to the office.
Easton then walked in and said, “Well, we keep telling her to take off all her clothes, but she’s not going to get any of it.”
The customer complained and when his son Justin called Tina to discuss the incident he said: “Well, that’s my dad. He’s from the old school.”
On another occasion, Tina bent down to pick up a pickaxe she had dropped. Easton said, “Oooh, while you’re down there darling…”
In September 2018, Easton added her to a WhatsApp group, where he sent 146 memes and 31 videos, all of which were offensive in some way.
Labor judge Corinna Ferguson said: “Overall we would describe them as extremely distasteful, crude and, by many, appallingly racist.
“Around 50 of the memes are sexual in nature. Some are just bad misogynistic jokes. Others contain pornographic images. One contains a manipulated image of a small naked boy with adult genitals.
“We find it extraordinary that a director and owner of a company would send messages of this nature to every employee.
“Tina did not find the news funny, she felt humiliated and bullied when she received it.
“We accept that they had the effect, although not the purpose, of offending Tina’s dignity or creating an intimidating, hostile, degrading, humiliating or offensive environment for her.
“These were extremely offensive messages sent by the company’s owner and director to a young employee.”
Tina repeatedly asked Easton to remove her from the WhatsApp group as she didn’t know how to leave herself, but he ignored all of those requests.
Eventually she asked her daughter to help her leave the group in February 2020.
After the mother was released three months later, she gave Easton a letter complaining about his “constant sexual remarks.”
Judge Ferguson found Tina the victim of sexual harassment and a “veiled threat” texted to her by Easton.
She was awarded £15,000 in compensation – for hurt feelings – and £4,000 in interest.
