A TikToker says a Los Angeles restaurant fired him, falsely claiming he was drunk so he couldn’t collect unemployment benefits.
User @d0nc0rle0nee posted a TikTok of a supervisor of his at Ysabel in West Hollywood on Saturday saying he was fired for being drunk. Then another Ysabel employee says, “Don’t say that.”
“My job tried to lie and say I got fired for being drunk so I wouldn’t get unemployment benefits,” @d0nc0rle0nee wrote in the video’s overlay text. As of Monday, his video has been viewed over 4 million times.

In a follow-up video, the TikToker speaks to another Ysabel employee and asks him why time has been deducted from his timesheet. The clerk says he doesn’t know what he’s talking about and when @d0nc0rle0nee asks for “his check” the clerk says he doesn’t know if he has it.
“He adjusted my time on my timesheet because I worked 8 hours without a break, which is illegal,” the TikToker wrote in the video’s overlay text.
In a closing TikTok, @d0nc0rle0nee says he was told to pick up a check on Friday. In the video, the three Ysabel employees seen in his other two videos tell him to come back on Monday and they can “talk”.
Commenters on @d0nc0rle0nee’s videos agreed with TikToker and said he was being abused.
“As long as they say the word fired, he gets benefits,” commented @dazaeth. “Drunk or not.” According to the California Employment Development Department (EDD), if fired, the employer must “prove there was misconduct” in order for the ex-employee to be denied unemployment benefits. Intoxication is considered misconduct.
“I’m assuming the ex-employer tried to lie about not getting benefits but screwed it up by saying fired,” wrote @ksa00012. “So he’s eligible for EDD.”
