The man of St. Paul charged with murder after man died following alleged attack

Phillip Charles Jones, also known as “Gunner,” 39, was charged in Ramsey County Court with second-degree murder in the death of Carlos Venceslado Rocha, 51.

Police responded to Rocha’s apartment at 647 N. Snelling Ave. twice – first on December 20th due to reports of Rocha being assaulted and seven days after a welfare check where they found him dead.

Jones, who has no permanent address, has been identified by others living in the apartment complex as the man who punched Rocha. According to the complaint, Rocha asked Jones to move his things that were blocking the hallway, and Jones responded in anger.

When interviewed by police, Jones said he “didn’t kill anyone and didn’t see anyone die”. He said he saw Rocha in the hallway, but did not admit to the assault, according to the allegation.

He said Rocha was drunk, tripped and fell, and that he helped him get the food he ordered and helped him get back to his apartment.

When the police arrived on December 20, they spoke to Rocha, who had dried blood on his face. The left side of his face was visibly swollen. The complaint states:

At the time, he told police around 3 p.m., he left his apartment to take a food order. That’s when he ran into Jones.

Rocha asked him to move, and Jones was furious. Rocha said Jones punched him with a fist in the face and walked away.

Rocha’s mother told police she spoke with him on the phone shortly before and after the conflict. She said Rocha told her “somebody just punched me in the mouth” and that he was “bleeding a lot”. The last time she spoke to him was December 23.

She asked the police to check on him on December 27, as she had been unable to contact him for several days.

When officers arrived, St. Paul was at the scene. They told officers that they used a ladder truck to enter the apartment by the window because the front door was secured and locked from the inside.

Paramedics found Rocha on the floor and said he appeared to have collapsed on his way to the bathroom. Employees found a “significant amount of blood” on the mattress, according to the complaint.

The Ramsey County Medical Examiner’s Office determined Rocha bled to death from a gunshot wound to the mouth.

Through witness reports and video surveillance, police were able to place Jones at the scene. Upon his arrest, Jones said, “I had a rage from hell; I will be honest with you,” according to the allegation.

Jones’ criminal history shows arrests for possession of weapons in Michigan, according to the lawsuit. In Minnesota, he has previous convictions for burglary, disorderly conduct and four counts of burglary. He also has five other counts of burglary pending and counts of burglary and arson, in which he allegedly burned down a home with two women in it. They escaped. He told police he was trying to put out the fire.

He appeared in court for the first time on Friday.
