A 3-year-old boy is in worsening condition after his aunt allegedly pushed him off a pier into Lake Michigan and watched him struggle to swim in the water below.

Victoria Moreno, 34, checked the area to see if anyone was looking before picking up the boy and throwing him into the water, where he struggled for nearly 30 minutes to stay afloat, prosecutors claimed on Wednesday.

“During either of these events, the defendant did not once yell for help, yell for help, beg for help, or attempt to help,” Assistant Prosecutor Lorraine Scaduto said during Moreno’s hearing.

Chicago Police Department officers pulled the toddler from Lake Michigan after about 30 minutes Monday and found he had gone into cardiac arrest.

Police arrived after passers-by called 911, prompting Moreno to pretend she didn’t know the child, according to the Chicago Sun-Times.

The boy is currently awaiting a heart transplant, but Scaduto said he is unlikely to survive.

Moreno allegedly stole keys to a family truck she wasn’t allowed to drive and took the boy to Navy Pier.

At one point, while walking with the toddler near the water, the child crawled under a barrier near the edge, but Moreno grabbed his foot and pulled him back “because there were several people in close proximity,” Scaduto said.

“The defendant looked around several times and waited for people to leave, looked around again, and when nobody was there, she let the 3-year-old child crawl under the chain to the edge of the platform — doing nothing,” Scaduto said .

Moreno was reportedly caught on surveillance video pushing the child into the water and doing nothing to save her.

Cook County District Court Judge Susanna Ortiz declined to set bail for Moreno during her hearing on Wednesday. Even as Moreno’s defense argued that she suffered from mental health issues, Ortiz called her alleged actions “intentionally brutal and heinous.”

Moreno was arrested at the scene and charged with attempted first-degree murder and aggravated assault of a child under the age of 13, resulting in a permanent disability.

She will appear in court on September 30.
