The alleged buffalo shooter has pleaded not guilty to domestic terror charges despite “overwhelming evidence” to his guilt

The 18-year-old, who is accused of killing 10 black people at a supermarket in Buffalo, New York, has pleaded not guilty to the 25-year indictment against him, which included hate-motivated domestic terrorism and other charges.

A lawyer entered the plea for Payton Gendron, who was wearing an orange jumpsuit with cuffs at his wrists and ankles.

Authorities say Gendron was targeting black people when he drove three hours from his home in upstate New York and shot 13 people with a rifle at a Tops grocery store in Buffalo on May 14. He killed 10 people, all black, in the attack.

“There is overwhelming evidence of the defendant’s guilt,” Assistant District Attorney John Fereleto said. “The defendant was caught at the scene with a gun in his hand.”

Not only was Gendron caught at the scene, but he was also implicated by his own writing and social media posts that include livestreamed video of the attack.

A 25-count indictment charges Gendron with injuring or killing the shooting “because of the perceived race and/or color of that person or persons,” a charge that would carry a life sentence without parole.

He was charged with murder shortly after the attack, but on Wednesday a new indictment expanded the case to include domestic terrorism charges, 10 counts of first-degree murder, 10 counts of second-degree murder as hate crimes, criminal possession of a weapon and three counts for attempted murder as a hate crime.

The domestic terrorism hate crime charge was signed into New York law two years ago after a mass shooting of Mexicans at a Walmart in El Paso, Texas. Gendron is the first to face charges under the law.

Gendron is being held without bail. He is scheduled to appear in court again on July 7.
