Carlson and others have noted that no one in the attack has been charged with “terrorism”. But there is no federal law that explicitly defines the crime of domestic terrorism.

Federal law makes it a crime to provide material support to designated foreign terrorist groups, which allows law enforcement agencies to arrest people who donate money or aid to organizations even if they themselves have not harmed anyone or threatened violence. There is no comparable law for those affiliated with extremist groups based in the United States, which enjoy broad free speech protections.

Members of two extremist groups, the Proud Boys and the Oath Keepers, face the most serious conspiracy charges during the January 6 riots.
