The new Bill of Rights could be “problematic” for Scotland, says the expert
UK government proposals to introduce a new Bill of Rights are “problematic,” said an expert.
Barbara Bolton, head of law and policy at the Scottish Commission on Human Rights, said the replacement of the current human rights law would create “a whole range of confusion and uncertainty”.
A plan to present a Bill of Rights was confirmed in the Queen’s speech on Tuesday, after a pledge to reform human rights laws was included in the Tory manifesto in 2019.
The government said the changes would strengthen “freedom of expression” and strike a “right balance” between individual rights and effective politics.
But Ms Bolton, testifying before Westminster’s Joint Human Rights Committee on Wednesday, warned of the problems this could create both for citizens and for the decentralization regime within the UK.
Ms Bolton told the committee that “significant progress” had been made since human rights law was created in Scotland.
“There is a lot to be done,” she insisted, but added that she did not “acknowledge” the “very negative portrayal” of the law in the consultation paper.
