Judge postpones trial of two ex-cops for Floyd’s murder until 2023

MINNEAPOLIS – The judge overseeing the remaining case of two former Minneapolis police officers who are charged Murder of George Floyd on Monday ordered the trial to be postponed to January to improve the prospects for a fair trial.

Tou Thao and J. Alexander Kueng are due to appear in court next Monday for aiding and abetting second-degree murder and second-degree manslaughter in the May 2020 death of Floyd. But Hennepin County Judge Peter Cahill on Monday ordered the trial to be adjourned to Jan. 5.

Cahill denied a defense motion for a change of venue due to the extensive pre-trial publicity surrounding the case. However, he said media reports and recent events surrounding related cases had created “a reasonable likelihood of an unfair trial” when it began next week.

Cahill quotes the May 18 plea of ​​guilty by Thao and Keung’s co-defendant, former officer Thomas Lane. He also quoted the beliefs of Thao, Kueng, and Lane on federal civil rights allegations in a separate trial in federal court in February.

The judge said those two events and the publicity surrounding them could make it difficult for jurors to presume Thao and Kueng are innocent of the state charges against them. So he ordered the seven-month delay to lessen the impact of that ad.

Cahill also presided over last year’s trial of former officer Derek Chauvin, who ended with a second degree murder conviction and a 22 1/2 year sentence for the white officer who knelt on the black man’s neck for 9 1/2 minutes despite Floyd’s fading pleas of “I can’t breathe.” The killing sparked global protests and a national reckoning with racial injustice.
