Social media users continue to follow the defamation trial of Johnny Depp and Amber Heard closely. Recently, a moment from the trial caught users’ attention: the apparent celebration of Depp’s legal team when Heard mentioned Kate Moss on the witness stand.
As she testified about her alleged abuse, Heard shared a story that mentioned Depp’s ex-girlfriend, Kate Moss. Heard previously told a UK court in 2020 that “[Depp] pushed Kate Mos down the stairs” and said that she “heard that from two people”. Neither Depp nor Moss have responded to this claim.
“All I see is my little sister with her…back to the stairs, and Johnny smacks her…I don’t hesitate, I don’t wait — I just think of Kate Moss and the stairs in my head right away, and I attacked him,” says Heart in the video. At the mention of Moss, it appears Depp’s attorney turns around and gives a fist pump.
In a video posted by law TikTokers and Harvard graduates Maclen and Ashleigh (@the.law.says.what), the duo opens up on exactly why Depp’s attorneys seem euphoric after Moss’ mention.

First, the duo plays a clip from the hearing, followed by both chiding both Heard and her attorney for the comment.
“OK, so studies are controlled environments, or at least try to be. You can’t just bring up whatever you want,” Maclen begins.
“For example, you generally can’t discuss past bad deeds,” Ashleigh adds.
This peculiarity seeks to ensure that the outcome of a trial is based on the exact incident found at the trial, rather than an assessment of the accused’s character. As Ashleigh points out, with a few exceptions, you can’t bring up previous, seemingly unrelated incidents in your case — “unless the other side answers the door.”
“Amber Heard brought up Johnny Depp’s past relationship with Kate Moss to imply that he pushed her down the stairs,” explains Ashleigh. Adds Maclen, “It’s possible that this opened the door for her to discuss past bad deeds in relationships.”
Corresponding news weekHeard was arrested in Seattle, Washington on September 14, 2009 after allegedly punching then-girlfriend Tasya van Ree in the arm. Van Ree has since stated that the event was “misinterpreted,” while Heard denied there was any domestic violence in the relationship, and in 2016 stated that there was “no physical violence, physical abuse, and no domestic violence at all between us.” “ have given.
Legal experts consulted by the New York Post agree with Ashleigh and Maclen’s assessment and said that mention could hurt Heard’s case.
“[Moss] is reportedly still friends with Johnny and her testimony wasn’t allowed to come out beforehand because it wasn’t that relevant,” said California entertainment attorney Mitra Ahouraian post Office. “This is a mistake [Heard] made, Kate brought up Moss, which possibly opened the door to [Depp’s team] bring [Moss] as a witness at the impeachment trial,” which in turn could provide Moss with an opportunity to deny the story.
At the time of writing, it’s unclear if the judge will allow further mentions of Moss. However, that didn’t stop TikTok commenters from offering their own take on this new development.
“I hope they call Kate Moss,” wrote one commenter.
“Ouuu this is going to be spicy,” added another.
Most of all, many were surprised that Moss was mentioned at all.
“I can’t believe her lawyers didn’t tell her not to talk about the past,” shared one user. In response, the duo wrote, “Oh I’m pretty sure they told her not to do that but she wasn’t listening.”
