Alec Baldwin claims cinematographer Halyna Hutchins gave him “instructions” on how to hold the gun that shot and killed her on the Rust set.
The actor was just seen publicly a few times since he was accused of firing the gun in the fatal tragedy.
The shooting also resulted in director Joel Souza being injured during a rehearsal for the film.
Baldwin’s attorneys have now filed a request for arbitration to relieve Baldwin of any financial responsibility related to Hutchins’ death.
The attorneys also say Baldwin’s legal fees will need to be covered by the production.
The documents filed further allege that Hutchins himself instructed the actor on how to position the gun: “She instructed Baldwin to hold the gun higher, to a point where it was pointed at her. She looked intently at the monitor and then at Baldwin and then back again as she gave those instructions.’
They added: “In issuing and following these instructions, Hutchins and Baldwin shared one basic, fundamental belief: that the gun was ‘cold’ and contained no live cartridges.”
In addition, the attorneys said Baldwin asked Hutchins if she wanted him to withdraw the gavel, adding that Hutchins replied in the affirmative.
Elsewhere in the documents, there are references to Baldwin’s interactions with Hutchin’s husband, Matthew, whom he met shortly after the shooting.
The 63-year-old’s lawyers claim that as a grieving Hutchins hugged Baldwin, he told the actor, “I think we’re going to get through this together.”
Matthew and his son are now suing Baldwin and others for wrongful death, with Baldwin’s document insisting it’s not the actor’s responsibility to check the gun for live ammunition.
Because of Baldwin’s title as executive producer on the project, lawyers say his contract means he must offer compensation for the loss and damage caused.
However, Baldwin’s reps say the Hollywood star was just a creative executive producer.
After the tragic incident, Baldwin initially said his “heart was broken,” although in an interview with ABC News in December he said he didn’t feel responsible for what happened.
“Someone is responsible for what happened and I can’t say who it is, but I’m not,” he told news reporter George Stephanopoulos at the time.
‘There’s only one question that needs to be answered, just one: ‘Where did the live round come from?’
A source claimed back in November that the 30-year-old rock star has been struggling since the shooting.
They said he had trouble sleeping and was being “haunted” by him. Hutchins’ death.
The insider also told People that Baldwin “is fighting because he clearly understands it’s even worse for Halyna’s family.”
The source continued, “He doesn’t want sympathy. He doesn’t want it to be about him. He just wants to help Halyna’s husband and child as best he can.’
So far, no one has been charged in the incident.
